Terms and Conditions of Use for Qbugs.io

1. Acceptance of Terms

By accessing and using the Qbugs.io platform (hereinafter, "the Platform"), owned by Qbit Mexhico S. de R.L., you (hereinafter, "the User") agree to comply with these Terms and Conditions of Use (hereinafter, "the Terms"). If you do not agree with these Terms, you must refrain from using the Platform.

3. Description of the Platform

Qbugs.io is an online platform offering project management tools, including the creation and tracking of bugs, real-time collaboration, analytics, and report generation. The Platform is designed for use by teams of various sizes and industries.

4. User Registration

To access the Platform's features, the User must register by providing a valid email address and, optionally, their name and photo. The User agrees to provide truthful information and keep it updated.

5. Plans and Fees

  • Free: No cost, allows up to 3 collaborators per project and 200 MB of storage.
  • Premium: $3.00 USD per user per month, with 1 GB of storage per user and technical support.
  • Enterprise: $5.00 USD per user per month, with 3 GB of storage per user and support for external users.

6. Payment Methods

Payments for Premium and Enterprise plans are made through PayPal. By subscribing to a paid plan, the User authorizes Qbit Mexhico S. de R.L. to charge the corresponding fees to their PayPal account.

7. Renewal and Cancellation

  • Renewal: Subscriptions automatically renew at the end of each billing period.
  • Cancellation: The User may cancel their subscription at any time before the end of the current billing period to avoid charges for the next period.
  • Refunds: No refunds are issued for payments already made.

8. Acceptable Use of the Platform

The User agrees to use the Platform ethically and legally, refraining from:

  • Engaging in illegal activities.
  • Sending spam or unsolicited content.
  • Uploading content that infringes on the rights of third parties.

9. Measures in Case of Non-Compliance

  • A warning will be issued to the offending User.
  • If there is no response within 3 days, the service will be suspended with the option for reactivation.
  • In case of recurrence, the account will be canceled without the right to a refund.

10. Intellectual Property

  • Platform Content: All intellectual property rights of the Platform and its content belong to Qbit Mexhico S. de R.L.
  • User Content: The rights to content uploaded by Users belong to them. The User is responsible for ensuring they have the necessary rights to upload such content and that it does not infringe on third-party rights.

11. Privacy and Data Protection

  • Data Collected: Email, name, and photo (the latter two are optional). Files uploaded by users.
  • Use of Information: The data is used to identify Users within shared projects. Other Users within the same project can access this information.
  • Sharing with Third Parties: Data is not shared with third parties unless required by law.

12. Information Security

Qbit Mexhico S. de R.L. implements security measures to protect User information. However, absolute security of information transmitted over the internet cannot be guaranteed.

13. Limitation of Liability

  • User Content: Qbugs.io is not responsible for content uploaded by Users.
  • Service Interruptions: Daily backups are performed. Service interruptions are resolved as quickly as possible, but Qbugs.io does not guarantee uninterrupted availability of the Platform.

14. Amendments to the Terms

Qbit Mexhico S. de R.L. reserves the right to modify these Terms. Modifications will be notified to Users via email or through the Platform. Continued use of the Platform after notification implies acceptance of the new Terms.

15. Applicable Law and Jurisdiction

These Terms are governed by the laws of Mexico. For the resolution of any dispute arising from the use of the Platform, the parties submit to the jurisdiction of the competent courts of Mexico City, waiving any other jurisdiction that may apply.
